2. Prices, description and availability of goods Prices are subject to change without notice and all goods are sold subject to availability. Orders must be placed for full carton quantities when applicable, failure to do so will result in your order quantity being rounded up to the nearest full carton quantity. Whilst we take the utmost care to ensure the product descriptions, pictures, information and prices are accurate we do not accept liability for any inaccuracies, errors or omissions. Colors may vary slightly from those shown on the website due to the limitations of Internet technology. Orders are accepted at our sole discretion and we maintain the right to decline orders without giving an explanation.
3. Sales tax Sales tax is calculated on shipping destination. When applicable it is included in the price for orders shipped to destinations in New Jersey. For orders shipped to destinations outside of New Jersey the price does not include any state or local tax. However, any orders may be subject to state or local sales tax. These are not included in our prices and customers remain liable for payment of these taxes on or following delivery.
4. Payment methods You may place your order online by contacting our sales department via phone or email. The contact us section of our website makes this information available. All invoices are in U.S. dollars and payment must be made in U. S. dollars.
We accept all major credit cards and will process checks electronically (below $2,999.00 value for each check).
5. Delivery arrangements All prices listed are for the material only and do not include delivery prices from our warehouse.We will however, make every attempt to get an accurate quote from a reputable shipper to have your order delivered. Any delivery times quoted are estimates, based on availability and normal delivery time.Please note that there may be certain destinations that incur higher than normal delivery fees due to urban congestion or being a remote location.
6. Returns/Shortages. You are responsible for immediately counting and examining the goods at the time they are delivered to you so that you will ascertain that they have arrived in undamaged condition, without any significant defects, and none are missing, before the representative of the delivering carrier leaves the premises where they were delivered to you. You understand that all tile is subject to some variation in shade of color and such is not a defect. If any of the goods are delivered to you damaged, or if there is any shortage, you are responsible for informing the representative of the delivering carrier at the time the goods are delivered to you and for initiating a written claim with the shipping/delivery service at that time, although upon your request thereafter to us we may at our sole discretion attempt to assist you in prosecuting the claim against the shipping/delivery service thereafter if you have timely and properly fulfilled those foregoing conditions. If upon delivery to you and before installation of the goods has begun, your inspection at the moment of delivery discovers that the goods are significantly defective, you must inform us of such in writing within twenty-four hours of delivery to you and timely cooperate with us to enable us to confirm that they are indeed significantly defective; and upon such a confirmation by us that the goods were sent to you in significantly defective condition, we will at our sole option either replace them or issue you a refund, provided that you have not begun installation of the goods and provided that you cooperate with us in immediately returning the goods to us if we request you to return them. Claims that are first communicated to us in writing later than twenty-four hours after the goods were delivered to you will be deemed invalid and will NOT be accepted regardless of the situation, and your failure to have properly communicated the claim within the initial twenty-four hour period shall be deemed a permanent and complete waiver of your claim. Other than when we are able to timely confirm that we sent you significantly defective goods AND you informed us of such in writing within twenty-four hours of their arrival to you and prior to beginning any installation of them, ALL orders are FINAL SALES and are NOT returnable, NOT exchangeable, and NOT refundable for any reason.

8. Limited Warranty and Limitations of Liability. We provide no warranty to you other than that we pass along to you, from the manufacturer, any manufacturer product warranty that may transfer to you as a purchaser of goods made by that manufacturer. The manufacturer's warranty information is generally available on the manufacturer's website, but upon your request we will assist you in determining what manufacturer warranty may be passed on to you by the manufacturer for the specific goods you purchase from us. WE MAKE NO OTHER REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, AND/OR AS TO MERCHANTABILITY, FITNESS FOR PARTICULAR PURPOSE, OR ANY OTHER MATTER WITH RESPECT TO THE GOODS. OUR LIABILITY FOR ANY AND ALL LOSSES OR DAMAGES RESULTING FROM ANY CAUSE WHATSOEVER, INCLUDING PRODUCT LIABILITY OR ALLEGED NEGLIGENCE, SHALL IN NO EVENT EXCEED THE PURCHASE PRICE YOU ACTUALLY PAID TO US FOR THE PARTICULAR QUANTITY OF GOODS IN RESPECT TO WHICH THE CLAIM OR ALLEGATION IS PROVEN TO BE VALID BY YOU, OR AT THE SOLE DISCRETION OF THE TILE STORE INC., THE REPLACEMENT OF THE GOODS.
